Court Denies Mamu Bail, Orders DSS to Provide Medical Care

Justice Mohammed Umar of the Federal High Court, Abuja, on Wednesday, dismissed a fresh bail application filed by the detained alleged terrorists’ negotiator, Tukur Mohammed Mamu.

In his ruling, Justice Umar acknowledged the health complaints raised by Mamu but held that his release on bail was unnecessary, directing instead that the Department of State Services (DSS) should provide him access to proper medical care.

“The detaining authority should not release him but take him to an appropriate health facility where he would be adequately attended to,” the judge ruled.

The court further observed that the prosecution had been diligent in handling the case, adding that such diligence undermined one of the key grounds on which bail could be granted.

“One of the reasons for granting bail is where the prosecution is not diligent. Since the prosecution in this case is diligent, the application for bail cannot be granted,” Justice Umar stated.

Justice Umar, however, ordered that Mamu’s defence counsel should select a health facility suitable for the defendant, to which the DSS must promptly take him for treatment.

The judge also directed the DSS to allow Mamu access to members of his family while in custody.

“The defence lawyer should choose the health facility comfortable to the defendant, to which he should be promptly taken,” the court ordered.

Mamu, a Kaduna-based publisher and alleged negotiator in the 2022 Abuja-Kaduna train attack, has been in DSS custody since his arrest in 2022. He faces terrorism-related charges brought by the Federal Government.
